This Privacy Policy outlines how Fast Slow Motion, LLC (“FSM”) uses the information collected through its website (that information and data collectively, the “Information”). FSM receives and has access to the collected Information from the individuals that use the sites (the “Users”). The privacy policy also incorporates by reference the Terms of Service and any other policies available on the website. By using or accessing the website, you accept the practices and policies outlined below, and you consent that we will collect, use and share your information as described in this Privacy Policy. 

FSM reserves the right, at its sole discretion, to change, modify, add or remove portions of this privacy policy, at any time. You are responsible for periodically reviewing the privacy policy for changes. By continuing to use the Website, you accept any changes at the time they are implemented. This Privacy Policy complies with the California Consumer Privacy Act of 2018 (“CCPA”), as well as the EU General Data Protection Regulation (“GDPR”) to give consumers the right to ask companies for information held about them. FSM is committed to maintaining and safeguarding the privacy of the collected Information it obtains through its relationship with its Users.

Scope

This privacy policy describes how any personal information collected as a result of your use of the Website will be maintained by FSM.

Collection of Personal Data & Company Data

When you access the website, FSM will collect some personal data from you. In some instances, FSM may gain access to some personal data through third-parties or affiliates. Some of the information that may be collected can include, but is not limited to:

  • login timestamps, source IP address and the user agent (browser and version);
  • AWS account IDs;
  • financial information such as credit card or bank account numbers;

  • supplemental information from third parties (for example, if you incur a debt to FSM, a credit check may be conducted by obtaining additional information about you from a credit bureau, as permitted by law); and

In addition to the Personal Data described above, FSM may collect Company Data including but not limited to:

  • Inventory and Supply Chain Data;

If you sign in through a third-party company, you are authorizing us to collect, store, and use, in accordance with this Privacy Policy, any and all information that you agreed that third-party company would provide to us through that company’s Application Programming Interface (“API”).

Data Security and Retention

FSM seeks to protect Personal Data from unauthorized access, use and disclosure using appropriate physical, technical, organizational and administrative security measures based on the type of Personal Data and how we are processing that data. As a User, you should also help protect your data by appropriately selecting and protecting your password or other sign-on mechanism; limiting access to your computer or device and browser; and signing off after you have finished accessing your account. Although we work to protect the security of your account and other data that we hold in our records, please be aware that no method of transmitting data over the internet or storing data is completely secure.

We retain Personal Data about you for as long as necessary to provide you with access to the website. Log data is specifically held for a period of one year. In some cases, FSM may retain Personal Data for longer, if doing so is necessary to comply with legal obligations, resolve disputes or collect fees owed, or is otherwise permitted or required by applicable law, rule, or regulation. FSM may further retain information in an anonymous or aggregated form where that information would not identify users personally.

Any protected health information (PHI) as defined by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) collected or stored by Fast Slow Motion shall be subject to a business associate agreement between the parties handling such PHI.

Third-Party Analytics

FSM and third-party technology providers, ad exchanges, ad networks, advertisers, agencies, ad exchanges, and ad servers with which we work may use third-party analytics services (e.g., Google Analytics) to evaluate your use of the Website, compile reports on activity, collect demographic data, analyze performance metrics, and collect and evaluate other information relating to Website usage. These third parties use cookies and other technologies to help analyze and provide FSM the data. You consent to the processing of data about you by these analytics providers in the manner and for the purposes set out in this Privacy Policy. Please be advised that if you opt out of any such service, you may not be able to use the full functionality of the Website.

FSM may share, transfer, or otherwise make available your Personal Data or Company Data to authorized third parties for various purposes including, to process information on FSM’s behalf, including service providers, to host the Website, serve advertisements, send emails on our behalf, run contests, promotions, conduct surveys and research, process any online transactions and to operate certain features on the Website. Further, such third parties may obtain Personal Data that you voluntarily submit to them to make use of the Website. FSM is not responsible for the collection and use of your Personal Data or Company Data by these third parties. FSM assumes no liability for any disclosure of Personal Data or Company Data due to unauthorized third-party access or other acts of third parties, or any other acts or omissions beyond reasonable control of FSM.

Use

All personal data collected will be used, primarily, to provide the Services in an effective and personalized manner. Your personal information may be used to:

  • Provide customer support and services as requested, including confirming emails related to the Website, reminders, and transactions.
  • Facilitate communication between interested parties registered on the Website.
  • Customize your experience and otherwise measure and improve the Website.

All users have the opportunity to opt out of receiving nonessential (i.e., promotional or marketing-related) communications from FSM after setting up an account. To remove your contact information from FSM’s lists and newsletters, simply unsubscribe by following the opt-out link included in each email.

Accessing, Reviewing and Changing Your Personal Information

You are responsible for the personal information you provide upon registering. You are also responsible for making any necessary changes to your personal data. If you request, FSM will close your account and remove your personal data from the Website according to applicable law. Some personal data will be maintained by FSM to comply with law, prevent fraud, collect fees, resolve disputes, troubleshoot problems, assist with any investigations, enforce the Terms of Service, and take other actions permitted by law.

Account Protection

Do not disclose your password to anyone. You are responsible for all actions of your username and password. Giving away your password will permit another person access to your personal data. If your password has been compromised, please change it immediately.

Security

FSM will make every reasonable effort to protect your personal data. FSM, however, makes no warranty or promise that your personal data or private communications will not be intercepted due to unauthorized access or disclosure.

Children

The Website is not directed to children under the age of 13. FSM adheres to the Children’s Online Privacy Protection Act (COPPA) and will not knowingly collect Personal Information from any child under the age of 13. If a child under the age of 13 has provided FSM with Personal Information, a parent or guardian of that child may contact FSM and request that such information be deleted from our records.

Notice to California Users

If you are a California user, the following provisions apply to our processing of information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household (“California Personal Information”). For California users, the provisions of this California Addendum prevail over any conflicting provisions in other sections of this Privacy Policy.

(d) Internet or other similar network activity: including, but not limited to, browsing history, search history, and information regarding a consumer’s interaction with a website, application, or advertisement. This category of information is collected from you and your devices.

(e) Geolocation data: including physical location or movements. This category of information is collected from you and your devices.

(f) Sensory data: including electronic, visual, or similar information. This category of information is collected from you and third parties such as linked sites.

(g) Inferences: such as a profile about a consumer’s preferences, characteristics, and behavior, drawn from information we collect and insights we receive from third parties such as our marketing and advertising partners and data analytics providers.

We may not discriminate against you because of your exercise of any of the above rights or any other rights, subject to the rights and the obligations under the California Consumer Privacy Act, including by:

  • Denying you goods or services;
  • Charging different prices or rates for goods or services, including through the use of discounts, loyalty program, or other benefits or imposing penalties;
  • Providing you a different level or quality of goods or services; or
  • Suggesting that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by law that can result in different prices, rates, or quality levels. Any permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. FSM will be the controller of your Personal Data processed in connection with your use of the Services. Note that we may also process Personal Data of our customers’ end users in connection with our provision of certain services, in which case we are the processor of Personal Data. If we are the processor of your Personal Data (i.e., not the controller), please contact the controller party in the first instance to address your rights with respect to such data.

You agree to indemnify and hold Fast Slow Motion, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against Fast Slow Motion by any third party due to or arising out of or in connection with your use of the Site.

Violation of These Terms of Use

Fast Slow Motion may disclose any information about you (including your identity) if it determines such disclosure is necessary in connection with any investigation or complaint regarding your use of the Site, or to identify, contact or bring legal action against someone who may be causing injury to or interference with (intentional or not) Fast Slow Motion’ rights or property, or the rights or property of visitors to or users of the Site, including Fast Slow Motion’ customers. Some violations may include:

  • Using the Site without the requisite ability or authority to ratify legally binding contracts, or while temporarily or indefinitely suspended from the Site;
  • Circumventing or manipulating the billing process, or any fees owed to Fast Slow Motion;
  • Distributing or posting spam, chain letters, or pyramid schemes;
  • Distributing viruses or any other technologies that may harm Fast Slow Motion or the interests or property of Fast Slow Motion customers;
  • Copying, modifying, republishing or distributing content from the Site or Fast Slow Motion’ copyrights and trademarks;
  • Impersonating another person or otherwise misrepresenting your affiliation with another person or entity
  • Conducting fraud, hiding or attempting to hide your identity
  • Providing inaccurate contact information
  • Harvesting or otherwise collecting information about users, including email addresses, without their consent;
  • Transmitting to Fast Slow Motion or any user any information or materials of any kind that (1) violate, plagiarize or infringe on the intellectual property or contractual rights of any third party (2) are libelous, defamatory, obscene, pornographic, abusive (3) contain any viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information.

Fast Slow Motion reserves the right at all times to disclose any information it deems necessary to comply with applicable law, regulation, legal process or governmental request. Fast Slow Motion may also disclose your information when it determines that applicable law requires or permits such disclosure, including exchanging information with other companies and organizations for fraud protection purposes.

You agree that Fast Slow Motion may preserve any transmittal or communication from you through the Site or any service offered on or through the Site, and may also disclose such data if required to do so by law or Fast Slow Motion determines that such preservation or disclosure is reasonably necessary to: (1) comply with legal process (2) enforce the Terms of Use (3) respond to claims that any such data violates the rights of others (4) protect the rights, property or personal safety of Fast Slow Motion, its employees, users of or visitors to the Site, and the public.

You agree that Fast Slow Motion may, in its sole discretion and without notice, terminate your access to the Site if it determines you have violated these Terms of Use or other agreements or guidelines associated with your use of the Site. You also agree that any violation by you of these Terms of Use will constitute an unlawful and unfair business practice that will cause irreparable harm to Fast Slow Motion. Because monetary damages for such a violation would be inadequate, you consent to Fast Slow Motion obtaining any injunctive or equitable relief it deems necessary or appropriate in such circumstances. These remedies are in addition to any other remedies Fast Slow Motion may have at law or in equity.

You agree that Fast Slow Motion may, in its sole discretion and without prior notice, terminate your access to the Site, for cause, which includes, but is not limited to: (1) requests by law enforcement or other government agencies (2) a request by you (3) discontinuance or material modification of the Site or any service offered on or through the Site or (4) unexpected technical issues or problems.

If Fast Slow Motion does take any legal action against you as a result of your violation of the Terms of Use, it will be entitled to recover from you, and you agree to pay, all reasonable attorneys’ fees and costs of such action, in addition to any other relief granted. You agree that Fast Slow Motion will not be liable to you or to any third party for termination of your access to the Site as a result of any violation of these Terms of Use.

Governing Law; Dispute Resolution

You agree that all matters relating to your access to or use of the Site, including all disputes, will be governed by the laws of the United States and by the laws of the state of Alabama without regard to its conflicts of laws provisions. You agree to the personal jurisdiction by and venue in the state and federal courts in Jefferson County, Alabama, and waive any objection to such jurisdiction or venue. Any claim under these Terms of Use must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred. No recovery may be sought or received for damages other than out-of-pocket expenses, except that the prevailing party will be entitled to costs and attorneys’ fees.

If there is any controversy or dispute between you and Fast Slow Motion arising out of or in connection with your use of the Site, the parties shall attempt, promptly and in good faith, to resolve any such dispute. If the parties are unable to resolve any such dispute within a reasonable time (not to exceed thirty (30) days), then either party may submit such controversy or dispute to mediation. If the dispute cannot be resolved through mediation, then it shall be submitted to legally binding arbitration. Judgment upon an arbitration decision may be entered in any court otherwise having jurisdiction. This provision is intended to be as broad as possible under the law: it shall apply to all claims and causes of action, including all statutory and constitutional claims, contract claims and tort claims.  The parties agree that their relationship affects and involves interstate commerce. YOU UNDERSTAND THAT DISPUTES RESOLVED UNDER THIS PROVISION SHALL BE THE SOLE REMEDY FOR ANY CONTROVERSY OR CLAIM ARISING OUT OF THE TERMS OF USE AND EXPRESSLY WAIVE YOUR RIGHT TO A LAWSUIT IN ANY CIVIL COURT EXCEPT TO ENFORCE AN ARBITRATION DECISION.

Void Where Prohibited

Fast Slow Motion administers and operates the Site from its location in Alabama, USA. Although the Site is accessible worldwide, it is intended for use within the United States. If you choose to access the Site from outside the United States, you are responsible for complying with applicable local laws.

Miscellaneous

You may not use, export or re-export any Content or any copy or adaptation of such Content, or any product or service offered on the Site, in violation of any applicable laws or regulations, including, but not limited to, United States export laws and regulations.

Each provision of the Terms of Use shall be considered severable, and if for any reason any provision or provisions herein are determined to be invalid, unenforceable, or illegal under any existing or future law, such invalidity, unenforceability, or illegality shall not impair the operation of or affect those portions of the Terms of Use which are valid, enforceable, and legal.

Fast Slow Motion’ failure to enforce strict performance of the Terms of Use shall not be construed as a waiver by Fast Slow Motion of any provision or any right it has to enforce the Terms of Use, nor shall any course of conduct between Fast Slow Motion and you or any other party be deemed to modify any provision of the Terms of Use. The Terms of Use shall not be interpreted or construed to confer any rights or remedies on any third parties.

Feedback and Information

Any feedback you provide regarding the Site is not considered confidential. Fast Slow Motion is free to use such information without restriction.
